Generality
Fast Life SARL is a limited liability company registered under number IDE/UIDECHE487.082.120; it owns the Fastauktion platform whose resources are solely the registration of the enricher on the platform and the sales commission paid by the purchaser in the event of conclusion of the contract.
Subject to mandatory legal provisions, the legal relations between the Fastauktion platform and its users, i.e. the bidder and/or the buyer, are governed by these general conditions; there is no exceptional or other agreement.
The bidder, as soon as his registration on the platform is valid, that is to say he has the status of being active in the automobile trade and the registration fee has been paid, this the latter is deemed to accept the general conditions without reservation or negotiation.
The bidder
The bidder must register according to the terms provided by the platform as a bidder and produce an extract from the commercial register proving that he is active in the automobile trade in the general sense of the term.
The bidder may, exceptionally, provide proof that he is active in the automobile trade in general by means other than the extract from the commercial register, such as a private and/or public organization certificate or any other form that the platform deems appropriate to decide whether or not it is an automobile trader.
The platform reserves the right at all times to accept or refuse a registration without giving reasons, and it also reserves the right to terminate a valid registration for just cause; by just cause, we mean all acts committed in bad faith, illicit or illegal by the bidder; if a termination with just cause is pronounced, it has immediate effect and does not result in any reimbursement of registration fees or any other damages.
The bidder may be a natural and/or legal person having its headquarters and/or domicile in Switzerland; the bidder undertakes to prove that he is not a robot, software or any other electronic form of means allowing the notion of automobile trader to be supplemented. The bidder cannot be an advertiser or sales subcontractor of any nature whatsoever in automobiles; the transfer of the bidder's contractual position is prohibited and ipso facto leads to the cancellation of the registration and the nullity of the contract.

The bidder undertakes to inform the Fastauktion platform of any change in their address, company name, headquarters, domicile or any other indication useful for maintaining their registration.
As long as the bidder is validly registered on the platform, he undertakes not to transfer, process or sell the vehicles subject to the Fastauktion auction. The bidder is however entitled to withdraw from the auction while retaining his registration the vehicle(s) until Monday evening at 6 p.m. or from Thursday morning at 7 a.m.; to make use of this right, he must respect the procedure established by the platform.
The platform reserves the right to consider that any registration which has not been renewed every three months is finished.
The successful bidder
The successful bidder is not registered on the platform and should not do so. The conditions for participation in the auction are those mentioned on the platform.
The successful bidder cannot be a robot, software or any other form which does not have the status of subject of law.
To participate in the auction, the auctioneer must register on the platform and thereby accepts all of these general conditions.
The successful bidder is by definition a bidder who agrees to be bound within the meaning of arts. 184 and 229 ss CO by entering into a sales contract with the bidder.
The successful bidder makes an offer which cannot be withdrawn under any circumstances. The bidder and/or successful bidder agrees to pay a commission in the event of a successful sale of CHF 29.- (twenty nine francs) to the platform, i.e. the administrative fees which appear on the price list that the can be found on the platform. The successful bidder does not respond adequately to his offer, he is deemed to be in default; only the bidder has the right to give this residence the appropriate legal action, the platform being in no way a party to this legal relationship.
The sales contract concluded between the bidder and the successful bidder is a sales contract without any guarantee and according to the sales contract model appearing on the platform
Auction
The auction is defined as in particular the period of time during which a sales contract can be concluded between the bidder and the successful bidder; Auctions take place from Tuesday at noon to Wednesday at noon, local Swiss time (summer time or winter time).
There are no auctions outside these periods; the platform does not have holidays, summer breaks, public holidays and so on.
The perfection of the auction is not achieved by the end of the bidding wars but by the passage of time; the successful bidder is thus deemed to be the one who offers the highest sum for a motor vehicle (or vehicles) within the time limit. of the auction, i.e. 24 hours.
The bidder must announce an offer to sell at a minimum price before the start of the auction, otherwise the auction item is deemed to be auctioned for the sum of CHF 1.- (one franc).
The bidder and the auctioneer declare by their registration accepted the fact that there has been no conclusion of the auction if the minimum price set is not reached within the deadline of the auction.
__The bidder and/or successful bidder waive any claim, request for damages and compensation if, for a reason beyond their control or linked to external circumstances, the platform cannot function normally; the latter is also not responsible for breakdowns or failures of concession companies in terms of access, dissemination and stability of data transmission._
Expenses
Registration for a bidder is CHF 21.- (twenty-one francs) and lasts 24 hours.
Registration as a bidder or successful bidder (buyer) is free; a commission of CHF 29.- (twenty-nine francs) is due to the platform as soon as the sale is concluded; the successful bidder is the debtor of this sum and declares that by registering on the platform this constitutes acknowledgment of debt within the meaning of art. 82 LPs.
